[摘要]随着2004年《道路交通安全法》、2006年《机动车交通事故责任强制保险条例》及相关配套规定的出台,我国道路交通事故责任认定原则及补偿事故损失的责任保险制度发生了根本性变化。这一变化集中反映为过错责任向严格责任的转变和第三者责任商业保险向第三者责任强制保险的转变。本文着眼于机动车与行人、非机动车之间的交通事故,通过对新旧制度的法经济学分析表明,在一定假设下,制度变迁提高了社会效率。 [关键词]法经济学;归责原则;交强险 [中图分类号] F840.69 [文献标识码] A [文章编号]1004-3306(2007)08-0021-03 Abstract: The implementation of the “Road Transportation Security Law” in 2004 and complementing measures of “Mandatory Motor Vehicle Traffic Accident Liability Insurance Provisions” in 2006 thoroughly changed the recognition principle for traffic accident liability and the liability insurance system for compensating for accident losses. The changes are replacement of fault liability by strict liability and the replacement of commercial thirdparty liability insurance to compulsory thirdparty liability insurance. The paper focused on traffic accidents between motor vehicle and pedestrian and nonmotor vehicles. It reached the conclusion that, with some assumptions unchanged, the new laws enhanced social efficiency by conducting an oldnew system analysis from the law economics perspective.
